DUI or Traffic Encounter with the Washington, DC Police | DC #duidefenseattorney

DC DUI Lawyer | DC Criminal Defense Attorney | DC Traffic Defense Lawyer

If the police detain you, there are two (2) questions you need to ask.
1) “Am I under arrest?” If the answer is yes, then you request counsel immediately; then remain silent: assert your Miranda rights.
2) If the answer is no, then you ask, “Am I free to leave?”
If the answer is yes, then you LEAVE. If the answer is no, you request counsel immediately and KEEP YOUR MOUTH SHUT!!

Too many clients say way too much. Be polite and provide the basics: license, insurance, registration. Be cooperative with generic requests; do not let an officer or his partner — playing good cop, bad cop — ‘trick’ you into saying or providing information which could potentially be used against later on in a court case. There is no prize for giving the officer as much information for him to use as evidence against you in a report that he is building unbeknownst to you.
